NVUS Websites Website Hosting Agreement

  1. Services Provided

NVUS Websites agrees to provide the following services:

  • Website hosting.
  • Provision and management of SSL certificates.
  • Regular backups of the website to ensure data recovery in case of failures.
  1. Ownership of Website and Domains
  • The Client retains full ownership of the website, including all content, design, and functionality.
  • Any domains purchased by NVUS Websites on behalf of the Client are the property of the Client. Domains may be transferred to the Client or another provider at any time, subject to legal restrictions imposed by ICANN and hosting payment being in good standing.
  1. Domain Transfer Policy
  • In accordance with ICANN regulations, domain transfers may not be made to a different registrar within 60 days of any changes to the registrant name, organization, or email address (or Administrative Contact email, if applicable).
  1. Payment Terms
  • Hosting fees will be charged on an annual or monthly basis, with payment due on the same day of each billing period.
  • If a payment attempt fails, NVUS Websites will make up to three attempts to collect payment over a period of no less than 30 days.
  • If payment remains unpaid after 30 days, NVUS Websites reserves the right to suspend hosting services for the Client’s website.
  1. Non-Payment Consequences
  • If payment is not made within 90 days, NVUS Websites reserves the right to let any associated domain names expire.
  • NVUS Websites may also delete all backup files and stored website data after 90 days of non-payment.
  1. Backup Policy
  • NVUS Websites will perform regular backups to ensure that the website data can be restored in case of unforeseen circumstances.
  • In the event of cancellation or non-payment, backups will be retained for 90 days, after which they may be deleted unless the account is brought current.
  1. Termination and Transferability
  • The Client with hosting payment in good standing has the right to request the transfer of the website and any associated domains to another hosting provider at any time, subject to ICANN regulations mentioned in Section 3.
  • NVUS Websites reserves the right to terminate hosting services if the terms of this Agreement are violated.
  1. Limitation of Liability
  • NVUS Websites will not be held liable for any loss of data, interruption of service, or any indirect damages arising from the services provided under this Agreement, except where gross negligence or willful misconduct is involved.
  1. Amendments and Modifications
  • NVUS Websites reserves the right to amend the terms of this Agreement with 30 days’ written notice to the Client. Continued use of services after such notice constitutes acceptance of the amended terms.
  1. Governing Law
  • This Agreement is governed by the laws of Washington, USA, and any legal disputes shall be resolved in the courts of Washington, USA.
